  • Tree Law’s Client: Seller of a property facing a claim from their buyer

 

The client faced a legal claim being pursued against them for failing to declare the presence of Japanese knotweed in their garden/close to their garden when selling their property. 

The buyer of the property claimed to have purchased the property above market value due to the effect that the presence of knotweed had on the property value.  The claim was about to be issued at Court but a mediation meeting was set up.  At the mediation a settlement of the dispute was reached which brought the dispute to a conclusion that was mutually agreeable to both our client and the Claimant.
