The presence of invasive species like Japanese knotweed and bamboo can be a real issue for home owners. Whether that is the plant causing damage to their property or causing a reduction in the value of the property.
Due to perceived risk, mortgage companies have been reluctant to loan against a property with Japanese knotweed within a given distance. This can mean that it’s not possible to secure insurance cover against the property. This causes significant risk issues.

The client faced a legal claim being pursued against them for failing to declare the presence of Japanese knotweed in their garden/close to their garden when selling their property.
The buyer of the property claimed to have purchased the property above market value due to the effect that the presence of knotweed had on the property value. The claim was about to be issued at Court but a mediation meeting was set up. At the mediation a settlement of the dispute was reached which brought the dispute to a conclusion that was mutually agreeable to both our client and the Claimant.
