Fallen Trees

We have all seen pictures of trees which fall over in stormy weather and block roads or land dramatically on cars or houses. This is a terrifying situation to everyone concerned as this failure poses a risk of damage to property but also a risk to life.

Diseased trees can greatly increase the risk of failure. Ash dieback for example is a fungal infection of Ash trees which has impacted the UK over the last decade. It is thought that a significant percentage of the UK’s Ash trees will die over the next decade. This risk means Ash trees, if not inspected for infection, could become infected and fail, falling over and causing damage.

Our client contacted us with concerns about significantly sized trees lining the road on which her property is located.  Every time there was stormy weather the client was concerned the trees would fail, fall and hit her house.  The trees were in the ownership of a private land owner, a local farmer.  The local farmer refused to take any steps to reduce or make-safe the trees despite being asked.  The client had contacted the local authority to ask them to exercise their powers under the Local Government (miscellaneous provisions) Act to end the land and take action to make the trees safe.  Whilst the Council had been to look at the trees they were reluctant to take this step.  The client reached out to Tree Law at that point.  We got involved and made contact with the land owner expressing our client’s concerns about the safety of the trees and asking that steps be taken to inspect the trees and make them safe.  In response to our communication the trees were reduced in size, removing the risk of them falling into our client’s property.  The client was delighted with this successful and very quick result.
